1. Agreement to Terms

By accessing or using BG-ProRemover's website and services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and BG-ProRemover ("we," "us," or "our") governing your access to and use of the Service.

2. Changes to Terms

We may modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on this page with a new "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

It is your responsibility to review the Terms periodically for updates.

3. Service Description

BG-ProRemover provides an online service that allows users to remove backgrounds from images using AI technology. The Service is available through our website at bg-proremover.com.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

4. Eligibility and Registration

To use certain features of the Service, you may need to register for an account. You must provide accurate, current, and complete information during the registration process and keep your account information updated.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet all eligibility requirements.

5. Subscription Plans and Fees

We offer both free and paid subscription plans. By signing up for a paid subscription, you agree to pay all fees in accordance with the pricing and terms displayed to you at the time of purchase.

Unless otherwise stated:

• All fees are in US Dollars and are non-refundable except as required by law or as explicitly stated in these Terms.
• Subscriptions automatically renew for the same period unless canceled at least 24 hours before the end of the current period.
• You can cancel your subscription at any time through your account settings or by contacting customer support.

We reserve the right to change our prices at any time. If we change pricing for your subscription, we will notify you before the change takes effect.

6. User Content and Rights

Content Ownership: You retain all rights and ownership of the images you upload to the Service ("User Content"). By using the Service, you grant us a limited license to host, process, and store your User Content solely for the purpose of providing the Service to you.

Image Processing: Our Service processes your images to remove backgrounds. The processed images are made available to you for download. For free users, both original and processed images are automatically deleted from our servers within 24 hours after processing. For paid users, images are retained according to your subscription plan.

Restrictions: You must not upload any User Content that:

• Infringes any third party's intellectual property rights
• Violates any law or regulation
• Contains illegal, obscene, defamatory, threatening, or otherwise harmful content
• Contains personal or sensitive information about individuals without proper consent
• Contains software viruses or any other code designed to harm computer systems

Content Monitoring: We do not actively monitor User Content but reserve the right to review and remove any User Content that violates these Terms.

7. Intellectual Property Rights

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are owned by BG-ProRemover or its licensors and are protected by copyright, trademark, and other intellectual property laws.

These Terms do not grant you any right, title, or interest in the Service or our content, nor any right to use our trademarks, logos, or other brand elements without our express permission.

You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless applicable laws prohibit these restrictions or you have our written permission.

8. Acceptable Use Policy

When using the Service, you agree not to:

• Use the Service in any way that violates any applicable law or regulation
• Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
• Attempt to gain unauthorized access to the Service, user accounts, or computer systems
• Use any robot, spider, or other automatic device to access the Service
• Introduce any viruses, trojan horses, worms, or other malicious code
• Use the Service to send unsolicited communications (spam)
• Use the Service to collect or harvest personal information about other users

9. Limitation of Liability

To the maximum extent permitted by law, in no event shall BG-ProRemover, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

Our liability is limited whether or not we have been informed of the possibility of such damages, and even if a remedy set forth in these Terms is found to have failed of its essential purpose.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. BG-ProRemover expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranty that the Service will meet your requirements, be available on an uninterrupted, secure, or error-free basis, or that the results that may be obtained from the use of the Service will be accurate or reliable.

You acknowledge that we do not guarantee that the background removal process will be perfect for all images, and results may vary depending on the complexity of the original image.

11. Indemnification

You agree to defend, indemnify, and hold harmless BG-ProRemover, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, any User Content submitted or shared by you.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

The provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

14. Dispute Resolution

Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the International Chamber of Commerce. The arbitration shall be conducted in English and shall take place in London, United Kingdom.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and we each waive any right to a jury trial.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and BG-ProRemover concerning the Service.
